Privacy Policy

This Privacy Policy describes the information collected by us through the Site and how that information is used and shared. This Privacy Policy also explains your rights and choices regarding your Personal Data, how we communicate changes to this Privacy Policy, and how you may contact us regarding questions or issues with respect to anything contained in this Privacy Policy.

We are committed to protecting the privacy of the Personal Data of users of the Site. Our employees have been trained on and understand the importance of our Privacy Policy and internal protocols, and follow them carefully.

By accessing or using the Site you agree to our privacy policy and terms of use, you agree on behalf of yourself and any company that you represent (together, “you”) that you have read and understand this Privacy Policy. This Privacy Policy is incorporated into and made a part of our Terms of Use. We may modify this Privacy Policy at any time. All changes will be effective immediately upon posting to the Site. Material changes will be conspicuously posted on the Site or otherwise communicated to you.

In operating the Site, your Personal Data may be transferred to, stored in, and processed in countries other than the country in which you are resident. Those countries may have data protection laws that are different from those of your country and, in some cases, may not be as protective. Specifically, our Site servers and some of our service providers are located in the United States and our affiliated companies and third-party service providers and partners operate around the world. This means that when we collect your Personal Data we may process it in other countries. We have, however, taken appropriate safeguards to require that your Personal Data will remain protected in accordance with this Privacy Policy.

1. Definitions

  • A “user” is someone who accesses, browses or in any way uses the Site or Site Content or receives electronic communication from us.
  • “Content” means text, images, photos, audio, video, and all other forms of data or communication.  “Your Content” means Content that you submit or transmit to or through the Site.  “User Content” means Content that users submit or transmit to or through the Site.  “Content” means Content that we create and make available on the Site.  “Third Party Content” means Content that is made available on the Site by parties other than us or its users.  “Site Content” means all of the Content that is made available on the Site, including Your Content, User Content, and Third Party Content.
  • The term “Personal Data” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

2. Purpose, Scope and Intent

2.1. The information that we may collect from or about you broadly falls into the following categories:

  • Information that you voluntarily provide to us, for example, your contact information, and product reviews.
  • Information that we collect through your use of the Site, for example, data collected by the servers used to operate the Site (e.g., IP addresses) and by cookies and other tracking technologies.

3. Information We Collect from You

3.1. We collect your Personal Data primarily from you. We may also collect information and Personal Data about you from other sources that we understand have a right to provide us such information and combine their information with our information in our databases. You can visit and use the Site without voluntarily providing us with Personal Data, but you may be required to provide Personal Data to use some tools and features of the Site. We will collect any Personal Data from or about you that you choose to provide to us, which may include your name, email address, physical address, and telephone number. If you provide your mobile or other telephone number to us, you consent to receiving telephone calls from us at that telephone number.

3.2. When you register for a consultation, provide consent to receive electronic communication from us (e.g., our newsletter), request franchise information, or otherwise contact us, we may collect from you certain information, including but not limited to the following: your first and last name; email address; mailing address; and phone number.

3.3. From time to time, we may request other Personal Data in order to provide features, functions or services for which such Personal Data may be required. . .

4. Your Consent; Unsubscribe

4.1. We may collect, use and/or disclose your Personal Data as set forth in this Privacy Policy, otherwise with your consent, and as otherwise permitted or required by law.   By providing Personal Data to us, you are consenting to its collection, use and disclosure as set forth herein.

4.2. We may also obtain your specific consent in your request for a consultation, consent to receive electronic communication from us or other documents, or by facsimile, electronic mail or telephone conversations with our employees, franchisees, representatives or agents.

4.3. We may also obtain consent with respect to your Personal Data from an individual representing to us that he or she has the authority to provide such consent on your behalf.

4.4. The form of consent may vary depending upon the circumstances and the type of information, including the sensitivity of the information and your reasonable expectations.

4.5. You may opt in or opt out of receiving marketing or promotional communications from us at any time by contacting us or by using our online subscribe/unsubscribe functionality as provided at the bottom of our emails.  You may withdraw your consent for any other identified purposes at any time, subject to legal and/or contractual restrictions and reasonable notice. We may not be able to provide you with a particular service, including without limitation electronic communications or access to the Site, if you withdraw your consent to certain uses of Personal Data.

4.6. From time to time, we may request information from you via surveys or otherwise. Participation in these surveys or other means is completely voluntary and you therefore have the choice whether or not to disclose the requested information.  Information requested may include contact information (such as name, email address and shipping address) and demographic information (such as postal/zip code, etc.).  Survey information will be recorded on an individual basis for the purpose of monitoring or improving the quality of the Site or for the other specific reasons given when the information is requested and may be added to your profile in our database.

5. What We Do with Your Personal Data and Who we Share it With

5.1. Personal Data may be used by, collected by, and/or disclosed by us to our franchisees, suppliers (e.g., Site management and hosting), IT vendors, service providers, agents, and affiliate organizations (collectively, “Recipients”) for the following purposes, some of which may be performed by Recipients. Please note that the franchisees are independent third-party entities. When we share Personal Data with the franchisees, we are not responsible for how the franchisees use such data.

5.1.2. For contract management and administration;

5.1.3. To provide information and services that you request, including without limitation in-home consultation, to respond to your comments and inquiries, and otherwise to communicate with you;

5.1.4. To display your Content on the Site for viewing by other users;

5.1.5. In top-level aggregated form to attract users, as well as to expand, reduce and otherwise make changes to the Site (such aggregated reports will not contain Personal Data);

5.1.6. For marketing and promotion of services to you that you have opted into, for example, to provide our newsletter or other marketing communications to you;

5.1.7. To meet legal and regulatory requirements or to disclose information when we believe in good faith we are compelled to do so by law, a subpoena, court order, regulatory body or similar legal procedure;

5.1.8. If we believe in good faith that the disclosure is necessary to prevent physical harm or financial loss or to report, investigate or pursue fraud or other suspected illegal activity;

5.1.9. In connection with our suppliers, vendors, and other business relationships involving us;

5.1.10. To analyze data individually or in aggregate to assist in our internal economic and demographic projections and to display that aggregated data to our franchisees;

5.1.11. For a business transaction, if we undergoes a change in control, acquisition, merger, reorganization, or asset sale, all information owned by or in the possession, custody, or control of us may be transferred, sold, shared, or otherwise disclosed to the successor of the transaction;

5.1.11. For other legitimate business purposes as permitted by applicable law; and

5.1.12. As may be otherwise authorized by you.

5.2. If your Personal Data is to be used or disclosed for any new purposes, we will, to the extent required by law, identify these new purposes prior to such use or disclosure and, if required, obtain your consent.

5.3. We will not sell any of your Personal Data that you provide to us or provide to an affiliated third party for the purpose of solicitation by a third party.  We do provide your Personal Data to our franchisees in the event you request additional information.

5.4. We may aggregate information or anonymize such information that is not publicly available, including User Content, in a manner that creates non-identifiable information and disclose such information to third parties for other marketing, promotional, statistical and useful purposes. In these situations, we do not disclose to these entities any Personal Data.

5.5. In some cases Personal Data may be disclosed, processed and/or stored outside of the country in which you or we reside, and therefore may be available to government authorities under lawful orders and laws applicable there.

5.6. Your Content that you provide is posted on the Site at your own risk. We cannot guarantee that Your Content will not be viewed by unauthorized persons. You understand that, even after removal, copies of Your Content you have provided may remain viewable in cached and archived pages and may have been copied or stored by Internet archives and other Site users. We may use and disclose Your Content, excluding components that consist of Personal Data, in any manner and with any person or entity.

6. Cookies and Other Tracking Technologies; Data Analytics and Behavioral Advertising

6.1. IP Addresses and Related Data.

(a)        When you use the Site, we may automatically collect certain information from your device. In some countries this information may be considered Personal Data under applicable data protection laws. Specifically, the servers used to operate and provide the Site may collect data pertaining to you and the equipment, software, and communication methods you use to access the Internet and the Site, including Internet protocol (“IP”) addresses assigned to the computers and other devices from where you access the Internet, your Internet service provider (ISP), your device ID number, your approximate geographic location, your browser type, the pages you access on the Site, the websites you access before and after visiting the Site, the length of time you spend on the Site, date and time stamps, and clickstream data.

(b)      We may use this information to administer the Site and its servers, to generate statistical information, to monitor and analyze Site traffic and usage patterns, to monitor and prevent fraud, to investigate complaints and violations of our policies, and to improve the Site’s content and the products, services, materials, and other content that we describe or make available through the Site (see also how we use Google Analytics as described below). We may combine this information with other collected information (including Personal Data) and information obtained from third parties for the purposes discussed herein. The suppliers that we use to provide the Site may collect information about your visits to the Site and other websites. Some of this information may be collected using cookies and similar tracking technologies as explained further below under “Cookies.”

6.1.1. Location Information. In addition to the approximate geographic location information collected as discussed above, we may, with your consent, access more specific location information to enhance the user experience and increase the usefulness of the Site. This includes both geographical location information that you input using the Site (e.g., when you enter your zip code, city, or physical address) and, as applicable, geographical location information collected by device-based location services (including GPS data). You may choose to allow us to access your location by granting the Site access to your location when prompted or through your device’s location services settings. The Site uses the Google Maps API(s). Pursuant to the Google Maps APIs Terms of Service, use of this location feature is also subject to Google’s Privacy Policy. Both the Google Terms of Service and Google’s Privacy Policy are incorporated into this Privacy Policy by this reference.

6.1.2. Cookies. The Site automatically uses cookies to track your use of the Site to facilitate and enhance the user experience on the Site and for other purposes as described herein. “Cookies” are small pieces of information that are stored on your device’s hard drive by your browser. The Site may use both cookies that we implement and cookies implemented by our suppliers and other third parties. We use cookies to track how you access and use the Site, to learn when and how users visit the Site, to learn how popular Site pages are and aren’t, to learn which search terms are used to find the Site, and to learn which websites direct you to the Site. We also use cookies to help display certain information on the Site and to improve your enjoyment of the Site, for example, by remembering your contact and other information when you access or use the Site. Most browsers automatically accept cookies. You can disable this function, but disabling cookies may impact your use and enjoyment of the Site. Our Site suppliers may use cookies and other tracking technologies, such as pixel tags, to track Site visitors across the Internet to understand how you get to the Site. We do not have access or control over these cookies and this Privacy Policy does not cover the use of third-party cookies.

Due to this automatic collection of data using cookies, we do not honor “do not track” requests.

6.1.3. Internet tags are smaller than cookies and tell the Site server information such as the IP address and browser type related to a user’s computer. Tags may indicate how many times a page is opened and which information is consulted.

6.1.4. Navigational data (including log files) are used for system management, to improve the content of the Site, for market research purposes and to communicate information to visitors. This may include the website you came from, your browser type, domain name and time and date of access.

6.1.5. When we send you emails, we may include a web beacon to allow us to determine the number of people who open our emails. When you click on a link in an email, we may record this individual response to allow us to customize our offerings to you. Web beacons collect only limited information, such as a cookie identifier, time and date of a page being viewed, and a description of the page on which the web beacon resides (the URL).  Web beacons can be refused when delivered via email. If you do not wish to receive web beacons via email, you will need to disable HTML images or refuse HTML (select Text only) emails via your email software.

6.2. The Site may contain links to other sites. The provision of these links is for your convenience only, and except for any sites that we own does not constitute an endorsement, recommendation or approval of such other sites. This Privacy Policy is no longer applicable when you leave our Site by way of links or otherwise. Linked sites may or may not maintain their own independent privacy policies and procedures. You should consult these policies and procedures before providing any Personal Data to these linked sites.

6.3. Social Media. We are active on social media, including Facebook, Twitter / X, YouTube, Pinterest, and Instagram. You have the opportunity to comment on those social media platforms regarding us and the products and services we offer. We reserves the right to post on its websites and social media pages any comments or content that you post on our social media pages available on any third party social media platform. We will be held harmless and without liability for the results of any and all third-party reposts to any and all other locations, including the direct or assumed meaning regarding content from all our social media websites.

The Site may allow you to connect to and share information with various social media platforms, for example, Facebook, Instagram, Twitter, LinkedIn, Pinterest, Google+, and others. These features may require us to implement cookies, plug-ins, and application protocol interfaces (APIs) provided by those social media platforms to facilitate those communications and features. We may share information that you provide us or that we may collect about your use of the Site with those platforms and that information will be subject to their privacy policies. We encourage you to review those platforms’ privacy policies, for example: Facebook’s Data PolicyInstagram’s Privacy PolicyTwitter’s Privacy PolicyLinkedIn’s Privacy PolicyPinterest’s Privacy Policy; and Google’s Privacy Policy. In addition, by choosing to use any third-party social media platform or choosing to share content or communications with any social media platform, you allow us to share information with the designated social media platform. We cannot control any policies or terms of such third party platform. As a result, we cannot be responsible for any use of your information or content by a third party platform, which you use at your own risk.

The Site may also use the advertising services and networks offered by those social media platforms to deliver advertising content. Use of these services requires social media platforms to implement cookies or pixel tags to deliver ads to you while you are logged into the platform.  For information your ad choices on the particular social media platform, please refer to the specific privacy policy of the platform.

6.4. Google Analytics. The Site uses Google Analytics, an analytics tool provided by Google to collect and process data (including Personal Data) about your use of the Site, including when you visit the Site, URLs of the websites that you visit prior to visiting the Site and when you visit those websites, and IP addresses assigned to the devices from where you access the Internet. Google sets and reads cookies to collect this data and your web browser will automatically send data collected by those cookies to Google. Google uses this data to provide us with reports that we will use to improve the Site’s structure and content. To prevent this data from being used by Google Analytics, follow the instructions to download and install the Google Analytics Opt-out Browser Add-on for each web browser you use. Using the Google Analytics Opt-out Browser Add-on will not prevent us from using other analytics tools and will not prevent data from being sent to the Site itself or to Google. You may disable cookies as discussed above, but that may impact your use and enjoyment of the Site.

6.5. Google Analytics’ Advertising Features. From time to time, we may enable and implement the following Google Analytics Advertising Features: Remarketing with Google Analytics, Demographics and Interest Reporting, Segments, DoubleClick Campaign Manager Integration, and DoubleClick Bid Manager Integration. Remarketing with Analytics uses Google Analytics cookies to serve advertisements to you across the Internet based on your visits to the Site. Demographics and Interest Reporting uses a third-party cookie to collect information about our Site traffic by tracking users across websites and across time, which generates a report for us to better understand our Site users. Segments allows us to isolate and analyze subsets of Site users by sorting our Google Analytics data. DoubleClick Campaign Manager Integration and DoubleClick Bid Manager Integration allow us to view, analyze, and create remarketing lists using our DoubleClick Campaign data. To opt out of remarketing advertising provided through Google, to customize your ad preferences, or to limit Google’s collection or use this information, visit Google’s Safety Center and Google’s Ad Settings and follow Google’s personalized ad opt-out instructions. Opting out will not affect your use of the Site.

6.6. Advertising Networks, Personalized Advertising, Remarketing, and Retargeting. From time to time, we may use or participate in advertising networks and related advertising services that are managed and provided by third-party advertising servers, advertising agencies, technology vendors, and research firms. These services collect information about your visits to and interactions with the Site and other websites and will use that information to target advertisements for goods and services. The information collected may be associated with your Personal Data. These targeted advertisements may appear on the Site or on other websites. Advertising networks often gather data about consumers who view advertisements to make inferences about a consumer’s interests and preferences, which enables their computers to deliver advertisements directly targeted to the consumer’s specific interests. This practice is often referred to as “online behavioral advertising.” For example, a third-party advertising network might collect the type of Internet browser you use, the type of computer operating system you use, the domain name of a website you visit, whether or not you visit specific pages of the Site and other websites, the location of your Internet service provider, the date and time of a visit to a website, and other interactions between you and a website.

6.7. Google AdWords. We may also use Google AdWords, an online advertising service provided by Google, to serve ads on our behalf across the Internet and sometimes on the Site. Google uses your Internet searches, cookies, and similar identifiers (e.g., pixel tags) to collect anonymous information about your visits to the Site and your interaction with our products and services to generate targeted advertisements to you on other websites that you visit across the Internet. To opt out of remarketing advertising provided through Google, to customize your ad preferences, or to limit Google’s collection or use this information, visit Google’s Safety Center and Google’s Ad Settings and follow Google’s personalized ad opt-out instructions. Opting out will not affect your use of the Site.

6.8. To change your preferences with respect to certain online ads and to obtain more information about third-party ad networks and online behavioral advertising, please visit the National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program. Please remember that changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may still see our ads from time to time.

7. Maintaining the Accuracy of Your Personal Data

7.1. You are solely responsible for the accuracy, completeness and up-to-date aspect of the Personal Data you provide to us.  We shall use reasonable efforts to keep our records of your Personal Data accurate, complete and up-to-date based upon the Personal Data we receive from you or through other sources.

7.2. You or a person authorized by you, are responsible for informing us about changes to your Personal Data that are necessary to fulfill the identified purposes, such as but not limited to: if your name or address changes; or if a contact person changes.

8.Safeguarding Your Personal Data

8.1. Access to your Personal Data is only given to individuals who need to know the information and whose duties reasonably so require the information in order to fulfill the identified purposes.

8.2. We strive to implement commercially reasonable physical, administrative and technological procedures, including firewalls, in an effort to protect your Personal Data  from loss or unauthorized access, disclosure, use or modification.  However, we cannot and do not guarantee that your Personal Data is and will remain secure.  Furthermore, we do not guarantee, warrant or represent that the Personal Data you provide will be transmitted securely or protected completely against interception during transit.  We accept no responsibility or liability whatsoever for any damages that may result where Personal Data submitted by you has not been securely transmitted, or has been intercepted, accessed, lost, misused or altered.

8.3. We use commercial reasonable efforts and protocols when we dispose of or destroy your Personal Data and to prevent unauthorized parties from gaining access to your Personal Data.

9. Special Note About Children

9.1. The Site and electronic communication from us are not directed towards children, nor do we believe that the Site will be of interest to children.  We recognize, however, the important safety issues regarding children who access the Internet.  We do not knowingly collect, use, or disclose Personal Data from children under the age of 18, and are committed to complying with all applicable laws and requirements, such as the United States Children’s Online Privacy Protection Act.  To remove the information related to a child who has provided Personal Data to us and permanently remove all Personal Data regarding this child from our database, you should contact our Privacy Officer as provided for herein.

10. Language and Governing Law
10.1. Where you obtain a translation of the English language version of the Privacy Policy or any other documentation, you agree that the translation is provided solely for your convenience and that the English language versions of the Privacy Policy and any other documentation will control.

10.2. Governing Law.  This Privacy Policy and all actions contemplated by the same shall be governed by and construed and enforced in accordance with the internal laws of the State of Arizona and the United States of America, as applicable, including the principles of conflict of laws thereof.  All acts involving the registration, use or operation of the Site shall be deemed as accessed, entered, perfected or finally accepted, at the place of the location of our headquarters, irrespective of the location of the Site servers.  All acts shall be considered as lastly accepted and perfected by us and at our headquarters.

11. Contact Information; Our Privacy Policies and Practices

11.1. You may challenge the accuracy and completeness of your Personal Data or otherwise access your Personal Data held by us and ask us to amend the information as appropriate. Under certain conditions as permitted or required by law, we may not provide you with access to your Personal Data kept in our file. Where we refuse your request, we will identify the reasons for refusing the request.  If a complaint is found to be justified, we will take appropriate measures including, if necessary, amending our policies and practices.

11.2. We have appointed a Privacy Officer who shall be accountable for our compliance with applicable privacy laws and this Privacy Policy.  If you have inquiries regarding your Personal Data held by us or if you wish to address a challenge regarding our compliance with this Privacy Policy, you may contact our Privacy Officer in writing at the address listed below:
